Freezing Assets: Delhi High Court Puts the Spotlight on Priya Kapur's Claims
The Delhi High Court's recent directive to freeze Sunjay Kapur's assets has brought the spotlight onto Priya Kapur's claims regarding the legitimacy of her late husband's will. The order, handed down by Justice Jyoti Singh, has significant implications for the distribution of Sunjay's vast estate, which includes equity shareholdings in three Indian companies and personal effects such as artwork.
The plaintiffs, comprising Sunjay's children from his previous marriage to Karisma Kapoor, have challenged Priya's claims, arguing that the assets need to be protected and preserved pending the disposal of the suit.
The court's interim order restricts Priya's access to Sunjay's bank accounts, provident fund, and foreign bank accounts, with the exception of withdrawals aimed at meeting his obligations related to his divorce from Karisma.
The freezing of assets has also raised concerns about Priya's ability to meet the plaintiffs' demands, which could potentially deprive Sunjay's children and his mother, Rani Kapur, of their legitimate share of the estate.
Sunjay's demise on July 12 last year, following a cardiac arrest triggered by the ingestion of a live bee, has added a layer of complexity to the litigative battle.
As the court continues to navigate the intricacies of the case, the legitimacy of Priya's claims and the distribution of Sunjay's vast estate remain uncertain, leaving the parties involved in a state of limbo.
The court's decision to freeze assets until doubts surrounding the will are settled has sparked heated debate, with some viewing it as a necessary measure to prevent any potential mismanagement of Sunjay's estate, while others see it as an overreach of the court's jurisdiction.
