Karnataka HC Upholds Deportation Notice to French National for Visa Violation

The Karnataka High Court has upheld a 'leave India' notice issued to 54-year-old French national Christophe Stephane Monxion, who had been running a restaurant and engaging in commercial activities in Gokarna, Uttara Kannada district, while on a tourist visa. Justice Sachin Shankar Magadum dismissed Monxion's petition challenging the March 16, 2026, order, affirming the government's authority to enforce visa compliance.
Monxion, who entered India on a tourist visa 15 years ago, argued that the 'leave India' notice was issued without providing reasons or a prior show-cause notice, rendering it procedurally invalid. The court found no merit in the contention, noting that engaging in business on a tourist visa is a clear breach of Indian immigration laws.
The court's decision reinforces strict adherence to visa regulations and affirms administrative action against foreign nationals violating the terms of their stay. The order is effective immediately, and Monxion is expected to depart India in accordance with the directive.
